§ 1 Terms & Conditions

These general terms and conditions (GTC) apply exclusively to entrepreneurs within the meaning of § 14 BGB. Entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

If you are not an entrepreneur within the meaning of the law, the general terms and conditions for consumers apply.

apidae candles is liable for the content of this website in accordance with the statutory provisions. However, apidae candles assumes no liability for the correctness and completeness of the content and information provided on this website.

The contract language is German.

§ 2 Offer and completion of contract

The order can be placed by telephone, in writing or by e-mail.

If an order is to be regarded as an offer according to § 145 BGB, apidae candles can accept it within two weeks. apidae candles informs the customer of the acceptance of the order with an order confirmation by e-mail or by sending the ordered goods. If the customer has selected advance payment or PayPal as the payment method, acceptance of the order is subject to timely payment.

§ 3 Prices, shipping costs and payment

The prices at the time of the order apply. All prices do not include the statutory VAT of currently 19% and plus EUR 9.90 shipping costs per order within Germany. For delivery outside of Germany, apidae candles will be happy to prepare an offer for you.

Payment can be made either in advance by bank transfer or by PayPal. With PayPal you have the option of paying either by direct debit, credit card, bank transfer or giropay. apidae candles reserves the right to exclude individual payment methods. If you select the payment method 'payment in advance', apidae candles will give you the bank details in the order confirmation email. The invoice amount must then be transferred to the account within ten (10) days, stating the order number as purpose. When paying via PayPal, apidae candles does not come into contact with the customer's bank details.

Payment by invoice is possible from the second order by prior arrangement. Apart from that, apidae candles reserves the right to exclude this payment method in individual cases. Invoices issued by apidae candles are due for payment within 10 days. In the event of default in payment, the customer is obliged to pay interest on arrears at an annual rate of 8 percentage points above the base interest rate. apidae candles is also entitled to withhold deliveries from other orders - to a reasonable extent - and to only carry them out against advance payment without prior notice.

The goods must be checked for glass breakage, damage and completeness immediately upon receipt. Defects must be noted on the carrier's shipping documents upon acceptance and confirmed by the carrier.

Obvious defects must be reported to apidae candles in writing immediately upon receipt of the goods. Obvious is a defect that a non-expert customer notices without closer examination of the services provided. All other defects must be reported to apidae candles in writing immediately after discovery.

Returns without prior consultation will not be accepted.

If a service provided by apidae candles is defective, the customer can demand supplementary performance within the statutory provisions. If the defect is not remedied by subsequent performance by apidae candles, the customer can reduce the purchase price in accordance with the statutory provisions.

§ 5 Delivery time

The agreed delivery time begins as soon as the order is confirmed by apidae candles.

In the event of delays in delivery, such as force majeure, traffic disruptions and occurrences from higher authorities, as well as other events for which apidae candles is not responsible, no claims for damages can be made against apidae candles.

§ 6 Retention of ownership

apidae candles retains ownership of the delivered item until all claims arising from the delivery contract and all other contracts with the customer have been paid in full.

§ 7 Passing of Risk

The risk is transferred to the customer as soon as the goods have been handed over to the transport person by apidae candles. If the customer defaults in accepting the goods, the risk also passes to him.

§ 8 Copyright

The graphics and images used and the reports are protected by copyright. Reproduction or use is not permitted without the express written permission of apidae candles. All rights reserved apidae candles.

§ 9 Applicable Law; Place of fulfillment; place of jurisdiction

Subject to other individual agreements, German law shall apply to the entire contractual relationship between apidae candles and the customer, excluding the UN Sales Convention.

The place of performance and exclusive place of jurisdiction for all disputes arising from the contract concluded with the customer or in connection with this is the place of business of apidae candles, unless otherwise stated in the order confirmation.

§ 10 Miscellaneous

Small deviations from the illustrations or descriptions of apidae candles are likely because they are hand crafted works. Claims for defects are not justified by this.
